It is important that salary and bonus provisions are drafted in a clear and coherent way. Bonus schemes should be kept as simple as possible.
In practice, employment agreements often contain inaccurate or intransparent bonus provisions. The term "bonus" does not even exist in the Swiss labour law, and therefore it needs to be analysed in each individual case what the term bonus stands for. Depending on the result, an employee either has a right to receive a certain bonus or the payment of a bonus is at the sole discretion of the employer.
Allowances and benefits for employees as well as working tools, such as the use of a company car, need to be settled carefully. Under certain circumstances, allowances may turn out to be normal salary.
